TD2 “Technical Offer” states that Part 5 should include: ”A list of the pre-existing rights (background) relevant to the tenderer’s proposed solution, in order to allow IPR dependencies to be assessed following the template provided in TD8”. Should the list provided in the TD8-Declaration of pre-existing rights be copied here or is something else requested? Additionally, should trade secrets be included in this list and in the TD8?

Yes, TD 8 template should be used. Any IPR(s) including trade secrets can be included.
